Constitutional Challenge to NYS Election Law

On Tuesday, August 5, 2019, Santiago Burger LLP and Holtzman Vogel Josefiak Torchinsky PLLC filed a lawsuit on behalf of concerned clients, challenging the constitutionality of New York State Election Law provisions that deprive minor parties of their own clearly marked ballot lines on Election Day. This law provides an unfair advantage to the two major parties (who enacted the challenges law) and violates new minor parties’ rights to free speech, free association, and equal protection of the laws.
